§ 40-514. Restrictions on business and industrial uses.
During any emergency declared by the city commission as provided in section 40-511, all businesses and industries using city water may be restricted to the use of 80 percent or a lesser percentage of the amount of water used by the respective businesses and industries during the corresponding month of the calendar year immediately preceding the effective date of the resolution declaring such emergency, as such percentage may be from time to time determined by resolution of the city commission duly adopted, with the following exceptions:
(1)
For businesses necessary to public health and welfare. The provisions of this section shall not apply to those businesses and industries designated by the city manager of the city to be necessary for the public health, safety and welfare, although he may require a reduction in the use of water as may be dictated from day to day by the total water supply available.
(2)
For food processors and manufacturers. Businesses and industries processing animal, fowl, vegetable, or mineral matter for food, or otherwise manufacturing food, shall be regulated in the uses of water as follows: The city manager shall determine the amount of water to be used for each business and processor, considering such factors as the demand for the food being manufactured or processed, the number of the persons employed by each respective manufacturer or processor, the regulations of all governmental agencies governing the use of water involved with respect to the manufacturing and food processing operations, the quantity of water demanded by each business or industry as compared to the total amount of water needed to supply the total normal demands for water on the city water system, and other pertinent factors.
